Л.в. устанавливается исходя либо из действительного экономического эффекта от использования лицензии, либо из предполагаемой прибыли лицензиата, не связанной во времени с фактическим использованием лицензии. В первом случае предусматриваются процентные отчисления от стоимости производимой и продаваемой лицензионной покупки (ройялти) или участия в прибыли лицензиата.
